ASPECTOS DE APLICABILIDADE DOS INSTRUMENTOS JURÍDICOS DE CONTROLE DA POLUIÇÃO POR AGROTÓXICOS

Abstract

Juridical instruments of pollution control are important components of the public politics related to natural resources and public health. In certain conditions, those instruments can be used to assure the public politics mentioned. The Brazilian juridical system hsa those instruments available to confront the possibility or the occurrence of the pollution for pesticides. Initial analysis of basic notions and terminology involved justify themselves because of the importance of the research activity and its evaluation. Those are used so much in documents, as in another bibliographical source, that it can be understood in many ways. It includes relationship of dates, facts and geopolitics situation concerning about the theme, and it comments, besides the implication with the social reaction to that pollution type. The new interpretations of the parameters of application has to be proposed and defended by the juridical responsability and the pesticide's registration concerning right. Basic references taken to sustainable development approach and the precautionary approach, both inserted in the Brazilian positive juridical system as it bases. It is still recognized in the Brazilian context the lack of control instruments for pesticides pollution that they did not include in the repressive group or control bureaucratic through the licensing. It was verified that the financial mechanisms motivated the pesticides' employment, as well as rural credit.
